Official Rules - Kentucky Derby "Road to the Roses" Fantasy Challenge 2010
The following internet based contest is intended for participation and viewing in the fifty (50) United States (except AZ, FL, NY and RI) and Canada (except Quebec) only and shall only be construed and evaluated according to applicable law. Void where restricted or prohibited.
ELIGIBILITY
Participants must be eighteen (18) years of age or older at date of registration and must have a valid, active email address and Internet access prior to February 10, 2010. Residents of Arizona, Florida, New York and Rhode Island, and other areas where prohibited are not eligible to receive prizes. This game is open only to legal residents of all fifty (50) United States and the District of Columbia (excluding AZ, FL, NY and RI) and all provinces of Canada with the exception of Quebec. Persons residing in any other jurisdictions may enter (unless this contest or entry into this contest is restricted or prohibited by applicable local law), but will not be eligible to win any prizes. All applicable federal, state and provincial laws and regulations apply. Contest begins at 12:00 p.m. ET, Wednesday, February 10, 2010 and ends at 11:59 a.m. on Saturday, April 24, 2010.
NO PURCHASE NECESSARY.
Employees of Churchill Downs Incorporated, horsemen, racing officials and their respective immediate family members or those living in the same household of such individuals are not eligible to win.
GENERAL CONDITIONS
By entering, participants agree to release, indemnify and hold harmless Churchill Downs Incorporated (“Sponsor”), its subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the contest or any prize won.
CONDUCT
The Official Rules will be posted on the Kentucky Derby “Road to the Roses” Fantasy Challenge Web site, www.roadtotheroses.com, throughout the contest. By entering this contest, you agree to be bound by these official rules and the decisions of Churchill Downs Incorporated and their sponsors, which shall be final and binding in all respects.
Churchill Downs Incorporated reserves the right to, at its sole discretion, disqualify any individual that: tampers or attempts to tamper with the entry process or the operation of the contest or Web site, violates the Official Rules or acts in any unsportsmanlike, rude, or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Churchill Downs Incorporated reserves the right to terminate or modify this contest at any time. Note: We are allowing stable names this year and any use of intellectual property infringement, defamation, profanity or other objectionable language or names could result in disqualification in the sole discretion of Churchill Downs Incorporated.
CAUTION -- Any attempt by an entrant or individual to deliberately damage any Web site or undermine the legitimate operation of the contest is a violation of criminal and civil laws. Should such an attempt be made, Churchill Downs Incorporated reserves the right to seek damages from any such person to the fullest extent permitted by law.
ENTRY
To enter the contest, go to www.roadtotheroses.com and complete the electronic registration form. All registrations must be received by Churchill Downs Incorporated by 11:59 p.m. ET, April 23, 2010. No faxed, mailed, electronically mailed, or phoned-in entries are allowed; this is an Internet-based game only.
LIMIT
Up to three stables per person; the information you enter into each of the fields of the electronic registration form must be unique. Duplicate entries are cause for disqualification of all involved entrants and stables, and are made at the sole discretion of Churchill Downs Incorporated.
Churchill Downs Incorporated is not responsible for lost, interrupted or unavailable hardware or software or telephone transmission or technical failures, garbled or jumbled transmission or other error of any kind, whether human, mechanical or electronic.
Once submitted, entries and correspondence become the sole property of Churchill Downs Incorporated and will not be returned.
CONTEST CRITERIA
Entrants' stables may consist of 2 jockeys, 2 trainers and up to 15 horses nominated to the 2010 Triple Crown. Your initial stable will consist of 2 jockeys, 2 trainers and 10 horses. Jockeys and trainers must be selected from official game lists.
You will be able to add 5 horses to your stable during the supplemental draft periods. Each stable can add three (3) horses in the first draft, and two (2) in the second draft, or you have the option to skip the first draft but add five (5) in the second draft. The options are outlined below.

STABLE CRITERIA
The number of contenders in a stable cannot exceed 19 (15 horses, 2 jockeys and 2 trainers). Initially, players will draft 10 horses, 2 jockeys and 2 trainers. In the first supplemental draft, players will be able to either add 3 horses to their stable or skip the first supplemental draft and wait to add horses to their stable in the second supplemental draft. In the second supplemental draft, players who added three horses to their stable in the first supplemental draft will be able to add 2 horses to their stable. If the player elected to skip the first supplemental draft, they will be able to add five (5) horses to their stable during the second supplemental draft period. Whichever option is chosen, a player will have a total of fifteen horses in their stable at the end of the second supplemental draft.
STABLE ACTIVITY
All horses in a player’s stable will remain active at all times and be eligible to score points. Players will have the opportunity to select five (5) “POWER” horses which are eligible to earn two (2) times the amount of points that non-power horses are eligible to earn. Players must determine which five of their 10 (of 12 or 15) runners will be designated as “power” horses for weekly scoring races. Players can change the designated “power” horses in their stable as many times as they wish, except on scoring race days. The feature will lock out at 12:00 p.m., noon ET on the day of each scoring race, and will unlock to allow changes in “power” status at 12:00 a.m. ET on the next non-scoring race day. The contest’s programming prohibits players from changing designated “power” horses on scoring race days after the lockout deadline. Players will enter their user name and password to view their stable, its score, and to manage their designated “power” horses.
LEAGUES
Account owners may set up leagues to invite players to compete against their stable(s).
Players that participate in a League will be able to view other stables in their league during game play. (The only information that will be available when viewing other stables will be the overall horse selection. Trainers, jockeys, and active/inactive horses will not be viewable. Only the entire horse list.)
SCORING
This contest will use a rotisserie scoring system. Each stable will be awarded points on the following basis:

Note: Any horse officially winning, placing or showing in the case of a dead heat will be given the place for which it tied for the purposes of determining a stable's score in this contest.
CHECKING STANDINGS
Participants may check their standing and lineup online at www.roadtotheroses.com (access via user ID and password) at any time after successfully registering for the contest.
Jockey, trainer and horse statistics do not count toward a stable's score before an entrant has officially entered the contest. Only the statistics in the races set forth above count toward a stable's score, occurring after sign up. Points can only be earned after successful enrollment in the game. Additionally, horses, jockeys and trainers not nominated to the game cannot generate points. NOTE: If you sign up on a scoring race day after 12:00 noon ET, you cannot earn points for any races until after the next non-scoring race day. For example, if you sign up at 2:00 p.m. ET on a Saturday, and there are scoring races on Saturday and Sunday, you would not be eligible to earn points for the races on those days.
NOTIFICATION
Winners will be notified by e-mail, regular mail and/or telephone within seven (7) days after the date the winners are determined. Winners will be required to sign and return tax forms if applicable, and an affidavit of eligibility and acceptance of these "Official Rules" and a publicity/liability release within fifteen (15) days following attempted notification.
By accepting any prize, except where prohibited by law, the winner (and, if applicable to the Grand Prize, companion) grant permission to Churchill Downs Incorporated to use their names and/or likenesses for publicity and promotional purposes without further compensation, and agree to execute a written consent. Winners are responsible for all taxes and must sign all eligibility, release and tax forms.
In the event of a dispute about the identity of any entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be required to provide Churchill Downs Incorporated with proof of identity, and proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
WINNER SELECTION
This is a game of skill. Winners will be determined by the objective criteria set forth below. From all eligible entries received, the winners will be the players who accumulate the most points during the Kentucky Derby "Road to the Roses" Fantasy Challenge contest according to these Official Rules.
Odds of winning depend on the number of eligible registrations received and skill level of each entrant. In the event of a tie between two or more eligible entrants, the winner will be the entrant that most closely estimates the on-track attendance of Kentucky Derby 136. In the event a tie situation still exists, the winning entry will be awarded to the entrant which verified the winning stable earliest in the contest.
Winners will be determined on or about 12:00 p.m. ET, May 11, 2010. Winning entries must confirm residence and eligibility to receive prizes. Prizes will be shipped between May 17, 2010 and June 30, 2010. Any winners unconfirmed by this date forfeit their prizes and an alternate winner will be selected.

Stage 1 prizes to be awarded to the officially registered stable that has accumulated the most points by [insert end time and time zone] on March 15, 2010. Stage 2 prizes to be awarded to the officially registered stable that has accumulated the most points by [insert end time and time zone] on April 12, 2010. Stables are bound by all Official Rules of the Kentucky Derby “Road to the Roses” Fantasy Challenge. In the event of a tie for winning position, the prize monies for the tied contestants will be divided equally among them.
Stage 1 Prizes:
$500 deposited into the winning entrant’s TwinSpires.com account (or $500 VISA Gift Card – winner’s choice)
Stage 2 Prizes:
$750 deposited into the winning entrant’s TwinSpires.com account (or $750 VISA Gift Card – winner’s choice)
WEEKLY PRIZE WINNERS
The 2010 Road to the Roses contest offers weekly prizes. For purposes of this game, a "week" will be Tuesday through Monday, from 12:00 p.m. ET on Tuesday through 12:00 p.m. ET on Monday. The prizes will be awarded weekly after each weekend's scoring races, with some exceptions. Please see the schedule below for more information. If there are scoring races on both Saturday and Sunday, the scores for both days' races will count toward the weekly prizes. Prizes will be awarded after each week for the duration of the Road to the Roses contest, with the exception of: the first week, February 20th; and the final weekend, Kentucky Derby. Therefore, there will be a total of nine weekly prizes. The weekly prize winners will be calculated according to this schedule.
To be eligible for a weekly prize, stables must have registered for the contest and verified their stable not less than seven days before the first scoring race in the weekly prize scoring period.

As an example: The first weekly prize winner will be the stable with the most points accumulated on the races run from February 20th through March 1st.
The weekly prize will be a $300 credit towards player’s TwinSpires.com wagering account or a Visa gift card – winner’s choice.
Tie-breaker: In the event that two or more people tie for the weekly prize top point total, the player who verified their stable earliest in the game will be deemed the winner. In the event that a tie remains, the prize monies will be split among the tied entrants. For example, if there are two individual tied for first place who verified their initial stables at exactly the same time, they will each receive a $150 credit towards their TwinSpires.com wagering accounts ($300 divided by 2 = $150 each), or a $150 VISA Gift Card – winner’s choice.

A winners' list will be posted on the game Web site, http://www.roadtotheroses.com/, after contest completion. Players also have the opportunity to view the complete standings for all stables online at http://www.roadtotheroses.com/ throughout the game. While every reasonable effort will be made to maintain and accurately reflect on standings, Sponsor and its agencies assume no responsibility or liability for the accuracy, completeness or currency of the standings information at any given time. Sponsor reserves the right at any time, without notice or liability of any kind, to revise, amend or modify the standings information. Sponsor may periodically update the standings at time(s) of its sole choosing and in its sole discretion; however, the foregoing does not represent a duty or obligation on behalf of the Sponsor to update any standings and the failure of Sponsor to do so for any reason will not result in liability to Sponsor. For the foregoing reasons, you are cautioned that inclusion of one’s name, stable or other identification on any posted standings does NOT constitute a representation by Sponsor that you have won a prize in the Contest.
